Terms of Service

1. Purpose and Relationship of Parties

These Terms of Service ("TOS") represent the basis of a contract between you, or the entity on whose behalf you are executing this agreement ("you" or "your"), and SAHAB AGENCY ("we", "us", or "our").

IMPORTANT NOTICE REGARDING SERVICE PROVISION: You acknowledge and agree that SAHAB AGENCY acts solely as an authorized reseller. The infrastructure, hosting environment, billing processing, technical support, and data management are provided directly by our upstream infrastructure provider, HeavenMark, Inc. DBA RunHost ("RunHost" or "Infrastructure Provider"), a Delaware corporation located at 300 Creek View Road, STE 209, Newark, DE 19711 United States.

By using our Services, you acknowledge that SAHAB AGENCY does not have direct access to your data, your server content, or your sensitive billing information. All such data is processed, stored, and managed exclusively by RunHost systems. Therefore, SAHAB AGENCY serves as the commercial point of contact, while RunHost serves as the technical service provider.

By corresponding with us, browsing our web properties, or using our Services, you accept these TOS and you agree to abide by the then-current version of these TOS and the integrated Policies (Acceptable Use, Privacy, etc.).

2. Customers and Liability Limitations

While SAHAB AGENCY facilitates your business on the Internet, we are an independent contractor. We are not liable for the actions of the Infrastructure Provider (RunHost).

Furthermore, because SAHAB AGENCY has no access to the physical servers, software environment, or customer data specifically:

• SAHAB AGENCY is not liable for data loss, server downtime, or technical errors caused by the Infrastructure Provider.
• RunHost (HeavenMark, Inc.) is a third-party beneficiary to this agreement for the purpose of liability limitation but is not directly contractually bound to you (the End User).

3. Services

SAHAB AGENCY resells a number of services and products which are collectively referred to in these TOS as the "Services". These Services are physically fulfilled by RunHost. Regardless of whether you pay for a Service or it is provided as part of a package, all Services are subject to each of our Policies.

a. Services Offer
The Services available for purchase include, but are not limited to:

• Shared Web Hosting
• Unmanaged and Managed VPS Hosting
• Reseller Hosting
• Cloud Hosting
• Unmanaged and managed Dedicated Server Hosting
• E-Mail Hosting
• Domain Registrations

b. Terms Specific to Domain Name Services
i. Domain Registration: We resell domain names through partnerships with ICANN-accredited domain registrars via our Infrastructure Provider. By using our Domain Name Services, you agree to be bound by the partner registrars' policies. We cannot guarantee that your domain name will be registered. It is your responsibility to ensure your domain name does not lapse.
ii. Transfer Lock Policy: ICANN's Transfer Policy requires a 60-day transfer lock to apply to your domain name(s) in the event of any "Change of Registrant."

c. Resource Usage
In using our hosting Services, you may not place excessive burdens on the CPUs, servers, or other resources provided by RunHost. Consistently reaching capacity numbers may result in restrictions, suspension, or termination of your account by the Infrastructure Provider.

7. Enrollment; Account Information

a. Enrollment
YOU WARRANT THAT BEFORE YOU USE ANY OF THE SERVICES OR SIGN UP FOR AN ACCOUNT THAT YOU ARE AT LEAST 18 YEARS OF AGE. You may be subject to a credit check and screening for potential fraud by the Infrastructure Provider.

b. Account Security
You are responsible for all actions performed under your account credentials. SAHAB AGENCY and RunHost are not liable for any damages, direct or indirect, that result from unauthorized account access.

8. Term of Agreement; Billing & Payment

a. Billing Execution
You acknowledge that all billing functions, credit card processing, and invoice generation are performed automatically by the RunHost platform. SAHAB AGENCY does not store or process your payment credentials.

b. AUTOMATIC RENEWAL
The Initial Term will AUTOMATICALLY RENEW for successive periods of equal duration. If you wish to discontinue the Services, you must submit a cancellation request through your customer panel at least one (1) day before the renewal date.

9. Money Back Guarantee

We offer a money-back guarantee for the first term of service only. You must notify us that you wish to cancel within the time frames set forth below. You will receive a full refund minus domain registration fees or non-refundable expenses.

• Hosting Products: 30 days.
• Domains, Servers, and Third-Party Products: Non-refundable (unless otherwise noted).

12. Data Backups

YOU ACKNOWLEDGE THAT IT IS SOLELY YOUR RESPONSIBILITY TO REGULARLY BACK-UP AND MAINTAIN COPIES OF YOUR DATA.

Because SAHAB AGENCY has no access to the physical storage or data contained within the Services, we cannot perform backups on your behalf. Neither SAHAB AGENCY nor RunHost is responsible for any data loss or corruption resulting from hardware failures, software failures, or account termination.

16. Disclaimers

EXCEPT AS EXPRESSLY PROVIDED, THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.

SAHAB AGENCY AND HEAVENMARK, INC. (DBA RUNHOST) EXPRESSLY DISCLAIM ANY LIABILITY FOR THE CONTENT OF ANY DATA TRANSFERRED TO OR FROM YOU. WE ARE NOT RESPONSIBLE FOR ANY LOSS OF DATA FOR ANY REASON.

17. Limitation of Liability

IN NO EVENT SHALL SAHAB AGENCY OR HEAVENMARK, INC. BE LIABLE TO YOU FOR ANY: (A) DATA LOSS, (B) DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR (C) LOST PROFITS OR BUSINESS INTERRUPTION.

SAHAB AGENCY 'S TOTAL LIABILITY HEREUNDER SHALL NOT EXCEED THE AGGREGATE FEES ACTUALLY RECEIVED BY US FROM YOU FOR THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY. AS RUNHOST IS A SERVICE PROVIDER TO THE RESELLER AND NOT THE CUSTOMER DIRECTLY, RUNHOST HOLDS NO FINANCIAL LIABILITY TO YOU.

19. Notices

Notices will be sent to you at the email address in your account. Notices regarding this TOS should be directed to the support portal provided in your customer panel.

20. Legal Jurisdiction

Choice of Law: These Terms of Use and your use of the services are governed by and construed in accordance with the laws of the State of Delaware, applicable to agreements made and to be entirely performed within the State of Delaware, without regard to its conflict of law principles.

Claims Period: No action or proceeding against SAHAB AGENCY or the Infrastructure Provider may be commenced by you more than one (1) year after the Service which is the basis for the action is rendered.

While SAHAB AGENCY is your primary contact for support and billing, legal notices regarding the physical infrastructure or copyright abuse (DMCA) regarding the RunHost network should be directed to:
